The following will apply when registering with Talent Scan:

DEFINITIONS

1. “Talent Scan” or “TS” refers to and means Talent Scan Pty Ltd.
2. “Talent Scan System” refers to and means all software, apps, databases, procedures, workflows and procedures utilized by Talent Scan under the Talent Scan brand, regardless whether online, offline, video or printed.
3. “Talent” refers to and means the following, including but not limited to:
   • Extra(s);
   • Background Artist(s);
   • Featured Extra(s);
   • Featured Background Artist(s);
   • Action extra(s);
   • Special Skills Artist(s);
   • Cast, Lead(s);
   • Featured Cast;
   • Actor(s);
   • Stand-in(s);
   • Walk-on(s);
   • Bitpart(s);
   • Voice over artist.

4. “User(s)” refers to and means any person, being crew or Talent, that makes use of the Talent Scan system.
5. “Data” refers to and means any information stored on the Talent Scan digital or analogue databases.
6. “Registrar” refers to and means the person directly responsible for the data to be supplied to Talent Scan for registering of new data or updating and amending existing data.
7. “Agent” or “Agency” refers to and means the company or person acting as an agent on behalf of any crew or Talent within the film and entertainment industries.
8. “Runlist(s)” refers to and means the list(s) of Talent compiled for a specific production day used for roll call and as timesheets.
9. “Talent Scan Film Industry ID”, “Talent Scan ID Card” or “Film Industry ID Card” refers to and means the RFID card created for Talent that registers with Talent Scan, utilized for identification and to scan and track Talent on the Talent Scan System.
10. “Talent Scan App” refers to and means any or all mobile, PC, Android, IOS or Windows application software designed to be specifically used as part of the Talent Scan system on any mobile phone, tablet, laptop, desktop smart watch or any other smart device.
11. “Timestamp(s)” refers to and means the time recorded and stored on the Talent Scan system.
12. “Checkpoint” refers to and means any place, access point or area where the identity of any Talent is checked for the purpose of any Talent Scan procedures on the Talent Scan system. This includes, but is not limited to, Pickup Area(s), Roll Call at basecamp or on location, Breakfast Area(s), Costume Area(s), Makeup Area(s), Props Area(s), Armoury Area(s), Lunch Area(s), Medical Area(s), Wrap at basecamp or on location, Drop Off Area(s), Casting Area(s) and Security Area(s).
13. “Banking Details” refers to and means all of the following details: Bank Name, Name of Account Holder, Branch Name, Branch Code, Account Number and Type of Account.
14. “Electronic Signature” refers to and means a signature created in a digital environment which is intended to provide a secure, unquestioned and accurate identification method for the signatory to provideapproval or confirmation on digital documents.
15. “Digital Signature” refers to and means a mathematical scheme for demonstrating the authenticity of digital messages or documents.

TERMS AND CONDITIONS

1. Talent Scan is not an Agent, and registration merely enables data captured on the system to be used in combination with Talent Scan software and digital services. Talent Scan shall thus not be responsible or held liable for any agency services including, but not limited to, procuring work for any Talent, booking Talent on any production, invoicing for Talent, payments for Talent, profile updates for Talent or procuring or arranging any kind of photo shoots for Talent.
2. Captured data is not the property of Talent Scan and shall be removed on request of the Registrar for the data. If said data is subsequently re-registered by a different Registrar, it will be available on the Talent Scan system once again until such time as such Registrar gives instructions to remove said data.
3. Talent Scan operates on the understanding that all data added to our system and our databases are accurate, truthful and current andwill not be responsible for or held liable for any inaccuracies which may occur.
4. Any Talent that registers with Talent Scan with only one Agent or no Agent will only be allowed to link one Agent to their profile.
5. Any Talent that registers with Talent Scan with more than one Agent will be able to link all their Agents to their profile, but will not be able to add any new Agents.
6. Each Agent of any Talent that is registered with Talent Scan at the time of Talent registration will be informed about the registration.
7. A registered Agent will have access to view any profile of any Talent registered with that particular Agent, as well as the Runlists containing such Talent. Such Agent will be able to view only the Talent booked on any production through said Agent, but will not be able to amend or change any data.
8. A Talent is required to carry their Talent Scan Film Industry ID card on any production and during any process they may be involved in regarding such production. This includes, but is not limited to, castings, call-backs, costume fittings, rehearsals, recording days and shoot days.
9. When making use of the Talent Scan system all users and Talent accept that any and all scanned times are truthful and accurate as the time recorded in real time and that no other confirmation or approval of working times are needed.
10. In the case of any person not being in possession of a relevant Film Industry ID card (or any other scanning material relevant to the workings of the Talent Scan system) to scan, a manual input of attendance at any or all checkpoints will be done by a crew member via the Talent Scan App. It is the responsibility of all users and Talent to ensure that the time(s) allocated to such manual input are correct and to confirm the times allocated by the crew member to be truthful and accurate as the time recorded in real time.  In doing so, such users and Talent confirm and agree that no other confirmation or approval of working times is required.
11. Failure on the part of any user or Talent to comply with clause 10. does not waive the terms thereof and Talent Scan will deem all timestamps recorded as truthful and accurate as the time recorded in real time, regardless whether done by scanning, manual input or any other method of capturing the times at any checkpoint.
12. The Talent Scan Film Industry ID card remains the property of Talent Scan Pty Ltd. However, it is the sole responsibility of to person to whom it is issued to ensure that it is kept safe and secure.  The Talent Scan Film Industry ID card is to be used only by the person to whom it is issued.  No card is transferable or allowed to be used on behalf of the person to whom it is issued by another person.
13. If a Talent Scan Film Industry ID card is lost or missing a new replacement card will be created for the relevant person and linked to their profile while cancelling the missing card from the Talent Scan system. A replacement fee of R75 will be charged, payable before or upon receipt of the new replacement card.
14. Once registered it is the responsibility of all users and Talent to enquire about the procedure to be followed to access their profile online.
15. It is the responsibility of all users and Talent to view their profile information online regularly and to ensure that all data is correct and current or to amend any data that is incorrect or has changed.
16. Banking details of all users and Talent are kept secure and encrypted and will only be used for production payroll services and Talent Scan premium membership services. It will not be shared with any third party.
17. It is the responsibility of all users and Talent to make sure all their banking details are correct and updated in the event of any change thereto.
18. Any digital/electronic signature used in conjunction with the Talent Scan system will be stored for 24 hours only as an encrypted file, whereafter it will be deleted. Thus a digital signature may be required periodically if needed.
19. Any stored digital/electronic signature will only be used for digitally signing documents associated with the film industry including, but not limited to, chit forms, artist release forms, IPA’s, time sheets, insurance, etc.
20. By signing a digital/electronic signature, or recording one on the Talent Scan System in any way, all users and Talent agree to the terms of use of said signature and gives Talent Scan permission to utilize said digital signature in any way needed for the proper functioning of the Talent Scan system and that no other confirmation or approval for making use of said signature is needed.
21. Talent Scan reserves the right to amend these terms and conditions from time to time without warning or notification.
